Hi Hank,

I am co-owner of a property management company in Pennsylvania. One of the properties we manage is a 58-unit complex. The only thing in the leases is that off street parking is included in the lease. That is all it says. Over time more and more tenants have moved in that have 2, 3, 4, 5, 6 cars and now we have a parking space problem.

Most of the tenants are on a month-to-month lease. I can understand that tenants under a lease that is 12 months (then goes month to month after initial 12-month term. Can I notify all tenants and if necessary, provide an addendum to tenants that if they are under a current initial lease term, that once their lease goes month to month, an addendum will be in place that will limit each apartment unit to 2 vehicles. Tenants on month-to-month lease will have 30 days’ notice. Do I need to do an amendment to their lease to limit a maximum of 2 cars per apartment?

Hi Edward,

I understand your dilemma with lack of parking due to some of the tenants having an extraordinary number of vehicles.

I think you are right on target as far as notifying all the tenants at this point to tell them what is going to be happening when their leases come up for renewal or extension.

I would let them know that there will be a two-car limit for parking and I would definitely do an amendment to the lease agreements when they come up for renewal. Be sure everyone is on the amended lease.
